Minifield April 25, 2011 Seminar Criminal Law and Procedure CJ 501 Double Jeopardy Double Jeopardy is a clause within the Fifth Amendment of the United States Constitution that prohibits an individual from being tried twice for the same criminal offense. If a person murders an individual, he or she can not be convicted twice of murder for the same offense. According the United States Constitution of the America, Amendment V (1791) clearly states â€Å"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of†¦show more content†¦United States, 163 U.S. 662, 16 S. Ct.1192, 41 L.Ed. 300 (1896). The same principle has been applied after conviction, in more recent years; but if a defendant appeals a conviction and succeeds, it is not double jeopardy for the prosecution to retry the defendant; unless a higher court (appellate court) rules insufficient evidence in the case to sustain the defendant’s conviction. Nor would it be double jeopardy in a case if the trial court declares a mistrial by the defendant. However, if the government moves for a mistrial and the defendant objects, and the mistrial is granted, the prosecution must establish a manifest necessity—that which is clearly a necessity or essential, in order for the retrial to be permissible. The defense of double jeopardy can be asserted by pretrial motion. It can also be asserted in any proceedings including criminal, civil, judicial, administrative, adjudicatory, and investigatory. Some states might not guarantee this right in their laws; however, because of the Fifth Amendment’s Double Jeopardy Clause, double jeopardy defense must still be afforded. There are many cases that reflect the protection of double jeopardy among many. For instances; the 1981 murder and conspiracy case against Kazuyoshi Miura became national spectacle. Legalizing Gay Marriage Essay Legalizing Gay Marriage Essay America is the land of the free, which gives each legal citizen the right of privacy, freedom of speech, and freedom of religion. This law also gives each citizen the freedom from religion. If you are Christian, Jewish, Muslim, or Buddhist, you are welcome in this country. However when the topic of gay marriage arises in conversations, the main opposing point would be that the bible doesnt agree with it. According to the first amendment, the bible has no standing in American law. Opposing gay marriage in my opinion is just another form of prejudice that is still being withheld. Im just waiting for someone to explain to me how this argument is any different from the one half a century ago when it was thought almost inconceivable for an African American to share the same water fountain, and ride next to you on a bus. On a common sense level, does American citizens really think that if gay marriage is not allowed, that the gay citizens are going to stop/change their way of life? But of course those who oppose giving citizens their freedom, really have no supporting facts to throw into the argument besides the religious ones. Yet, how do we know for sure that the religious reasons are even factual? Yes, it says so in the bible, whose bible? To my knowledge, as stated above, I wasnt aware that America had a religion that everyone abided to. In fact, most religions are unopposed to gay marriage. Its been said, gay couples are unnatural. Human beings are animal species, and according to scientific studies the 1500 animal species that have been extensively studied, 450 of those animal species have shown homosexual behaviors such as displays of affection, life long bonding, and sex. So just because we are inferior to all other animals on earth doesnt change the fact that our species as a whole has a percent that shows homosexual tendencies. If you ask me, its also unnatural and immorally wrong for a man to beat his wife and children, and many people disagree with it, but it will never be changed. People are going to do what they wish, because every human being is different, and whoever wants them all to be the same, has bigger problems than disagreeing to gay marriage. If a couple, gay or not has a love that deserves a marriage, why deny them that right when others who dont deserve anything in this world are granted it so easily? So what bothers everyone so much? I mean since this is a free country and all, and everyone has privacy and is allowed to do whatever they want behind closed doors, then why cant the bond of two people be made official to the public if they feel the need to do so. Life is too short for people who are happy not to be able to strive for the goals that they really care about. So why waste your time arguing over the happiness of people who arent going to change over a law that the public could make. If youre asking why I feel so strong on this subject, or why i was inspired to write about this, besides the reasons mentioned, I can say that ive lived with gay individuals in my life. One of my best friends in the world, had to come to the realization of being gay last year. So some of those who argue that people that are gay can help it obviously havent met anyone who is. So much of the public is close-minded on this issue because of that fact.
